SimpleDiagrams Shape License

1. What this license covers

This SimpleDiagrams Shape License (the Shape License) governs artwork, symbols, icons, illustrations, native vector data, and shape libraries supplied by McQuillen Interactive Pty. Ltd. (McQuillen Interactive) with or for use in SimpleDiagrams and identified as being covered by the “SimpleDiagrams Shape License” (the Covered Shapes). It applies whether a Covered Shape is bundled with the application or later made available by McQuillen Interactive for free or for a separate price.

The price, delivery, refund, and other transaction terms for a separately supplied shape or library will be shown when it is offered. Unless different content-license terms are clearly identified before acquisition, that shape or library is governed by this Shape License.

This Shape License grants rights in the Covered Shapes. It is not a license for the SimpleDiagrams application itself. Your use of the application is governed by the end-user license agreement that applies where you acquired it. For a copy acquired through the Mac App Store, Apple’s Standard Licensed Application End User License Agreement applies unless a custom agreement is displayed by Apple.

Third-party artwork and libraries are not Covered Shapes. They remain subject to the license and attribution information displayed with them.

2. License grant

If you lawfully acquire and use SimpleDiagrams and lawfully obtain the applicable Covered Shapes, McQuillen Interactive grants you a non-exclusive, worldwide, royalty-free license to use, arrange, resize, recolor where supported, label, combine, and modify those Covered Shapes in diagrams created with SimpleDiagrams.

You may reproduce, publish, display, and distribute finished diagrams and diagram exports for lawful personal, educational, editorial, charitable, and commercial purposes, including:

presentations, reports, dashboards, documentation, and training material;
websites, social media, advertising, marketing, and sales material;
books, publications, packaging, and merchandise;
video, film, television, and other electronic or print media; and
work produced for clients as part of a broader professional service.

No attribution is required for a Covered Shape unless its library information expressly says otherwise.

You may share an editable SimpleDiagrams document with another lawful SimpleDiagrams user for genuine collaboration on that diagram. A finished diagram or editable diagram document does not become a prohibited shape library merely because its file format contains an embedded or vector representation of a Covered Shape, provided its purpose is to communicate or edit the diagram rather than distribute reusable shape assets.

3. Finished output

You retain your rights in the original text, data, arrangement, annotations, and other material you add to a diagram. McQuillen Interactive retains its rights in the underlying Covered Shapes.

Your right to continue using, displaying, reproducing, and distributing a finished diagram or export that was lawfully created under this Shape License is perpetual, provided you continue to comply with its restrictions.

4. Restrictions

Except where applicable law does not permit a restriction, you must not:

extract, scrape, republish, sell, sublicense, transfer, or distribute a Covered Shape or shape library as a standalone or substantially reusable asset;
use a diagram or document primarily as a way to give another person access to reusable Covered Shapes;
make the source or native shape data available in a form intended for independent reuse outside a genuine finished diagram or collaborative SimpleDiagrams document;
use Covered Shapes as source material to create a competing stock-art, icon, template, component, or diagram-shape library;
use a Covered Shape, or a confusingly similar adaptation, as a trademark, service mark, logo, or other source identifier without McQuillen Interactive’s prior written permission;
remove a required copyright, license, provenance, trademark, or attribution notice;
claim ownership of a Covered Shape or imply that McQuillen Interactive endorses you, your organisation, or the subject represented by a Covered Shape; or
use a Covered Shape unlawfully or in a way that infringes another person’s rights.

Using a Covered Shape as this Shape License permits does not breach these restrictions merely because the supplied shape itself is found to infringe another person’s rights.

You may make reasonable backup, cache, and working copies created through ordinary use of SimpleDiagrams. This does not permit you to maintain or distribute a separate collection of Covered Shapes.

5. Modifications

You may modify a Covered Shape as part of a permitted diagram or finished output. Your contribution to a modification remains yours to the extent it is independently protectable, but modifying a Covered Shape does not transfer ownership of the original shape or grant rights to distribute the modified shape as a reusable asset. A modified Covered Shape remains subject to this Shape License.

6. Your artwork and third-party material

This Shape License does not claim ownership of original artwork or libraries that you create. You are responsible for ensuring that you have the rights needed for material you import or add to SimpleDiagrams.

A third-party shape or library is governed by its own displayed terms. This Shape License does not restrict rights granted directly by an applicable third-party or open-source license.

7. Ownership and reserved rights

The Covered Shapes are licensed, not sold. McQuillen Interactive and its licensors retain the intellectual property rights they hold in them. We grant permission only to the extent we own the relevant rights or are authorised to license them. We do not claim that copyright or another exclusive right exists in every individual shape, symbol, or element. All rights we hold that are not expressly granted by this Shape License are reserved.

“SimpleDiagrams,” its logos, and associated product identity are trademarks or other source identifiers of McQuillen Interactive. This Shape License does not grant permission to use them except to identify genuine SimpleDiagrams output truthfully.

8. How the shapes were made

The original shapes in the SimpleDiagrams 4 libraries were drawn by hand, and some of them have since been redrawn with AI. Many later shapes, including additions to some of those libraries, were drawn by AI models to our direction: mainly Claude, made by Anthropic, and also Codex, made by OpenAI. The AI models wrote the drawing code and geometry that produce these shapes, and we reviewed and selected each shape for appearance and fit. That review is not a legal clearance. A library can therefore contain both hand-drawn and AI-made shapes. The libraries that contain AI-made shapes are: Basic, Biz, UI Flow, and Value Stream, which add AI-made shapes to their original hand-drawn ones; and Aged Care, Aged Care 2, Azure, BPMN, Building Monitoring, Cooking, Data Centers and AI, Green Walls, Hobby Electronics, Hobby Electronics Notebook, Home Energy Efficiency, HVAC, Insurance, Regenerative Farm Isometric, Regenerative Farm Plan, Regenerative Farm Plan (Watercolor), Solar & Battery Sites, Solar & Battery Sites 2, Tool & Die, and UML, in which every shape is AI-made. A library released on or after 23 October 2026 says in its library information whether it contains AI-made shapes.

You may use every Covered Shape as Section 2 allows, however it was made. Because the law on AI-made material is still developing, some shapes may not be protected by copyright. We therefore cannot promise that you will have exclusive rights in a shape, or that you could register a shape, or a design based on one, as a trademark. We cannot see what material the AI models learned from, so we cannot guarantee that no shape resembles someone else's work. If your use needs artwork that is guaranteed to be human-made, exclusive, or cleared of all third-party rights, please use other material. We do not provide an intellectual property indemnity unless we agree to one in writing.

Some shapes may depict a third-party logo, brand, or product, or a protected emblem such as the Star of Life. Your use of such a mark or emblem is your responsibility, and this Shape License does not grant any right in it. You are also responsible for what you add to a diagram and for how you use the finished diagram, including any logos, names, or likenesses you include. If someone tells you that a shape copies their work, please let us know as described in Section 9.

9. Supplied artwork: warranties, liability, and rights complaints

Nothing in this Shape License excludes, restricts, or modifies a guarantee, right, or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded. Where applicable law permits a limitation to replacement, repair, resupply, or payment of the corresponding cost, we may limit the relevant remedy only to the extent that doing so is lawful and fair and reasonable.

Other than those guarantees and our express promises in this Shape License, we do not promise that a supplied shape is free of third-party rights or will meet every legal or commercial requirement of a particular use, and supplied shapes and libraries are otherwise provided as is. This does not limit an express permission in this Shape License.

Subject to those non-excludable rights and remedies, to the maximum extent permitted by law, neither party is liable under this Shape License for indirect, incidental, special, exemplary, or consequential loss, or for lost profit, revenue, goodwill, opportunity, or anticipated savings, arising from supplied shapes or libraries. This exclusion does not apply to fraud, wilful misconduct, a breach of Section 4, or infringement of the other party's intellectual property rights. A library being free does not, by itself, remove liability or reduce a statutory remedy to zero.

Subject to the non-excludable rights and remedies above, to the maximum extent permitted by law, our total aggregate liability to you arising from supplied shapes and libraries in the 12 months ending on the date of the event giving rise to the claim is limited to the greater of AUD 100 and the amount you paid during those 12 months for the affected shapes, libraries, and applicable SimpleDiagrams application licence or Cloud subscription, including amounts paid through an authorised seller. This is one aggregate cap, not a separate cap for each claim or shape. The cap does not apply to fraud, wilful misconduct, infringement of the other party's intellectual property rights, or liability that cannot lawfully be limited. It does not limit a statutory remedy that the law requires us to provide.

You remain responsible for material you add, changes you make, and unlawful uses you choose. You are not required to defend or indemnify us merely because a claim concerns a supplied shape used as we permit, including as resized, recoloured, combined, or otherwise modified as this Shape License permits, except to the extent the claim arises from material you added. If you also have a SimpleDiagrams website account (for example, to download libraries, retrieve a licence key, or use SimpleDiagrams Cloud), such a claim does not, by itself, trigger the customer indemnity in the website Terms. Nothing in this Shape License binds a third-party rights holder or prevents a claim by that person.

If you receive a rights complaint concerning a supplied shape, please contact us promptly with the library name, shape name, and the complaint details. Rights holders may also contact us at support@simplediagrams.com. Our Copyright Complaints Policy explains what a complaint should contain and how we handle it. We will assess the report and may stop distributing, replace, or revise affected artwork. If a change affects your use, we will explain the available steps and any applicable remedies. If we tell you that a shape has been withdrawn after a rights complaint, please stop making new uses of it; we will offer a replacement where we can or, for a paid library, an appropriate remedy. This process does not limit statutory rights or promise that already distributed diagrams can be recalled.

These provisions apply to Covered Shapes whether bundled or downloaded separately, free or paid. They also apply to AI-assisted and AI-generated artwork. If you also have a SimpleDiagrams website account (for example, to download libraries, retrieve a licence key, or use SimpleDiagrams Cloud), then for a claim to the extent it concerns supplied artwork, the warranty and liability provisions in this section apply in place of Sections 12 and 13 of the website Terms, including their loss exclusions and monetary cap. For a claim about supplied artwork, they also apply in place of the warranty and liability section of the SimpleDiagrams Desktop Licence Agreement, if you have agreed to it. The website Terms continue to govern claims concerning the Cloud Service itself. The two monetary caps do not accumulate for the same loss.

10. Relationship to the application license

This Shape License is the only licence for Covered Shapes used in SimpleDiagrams for macOS, including shape libraries downloaded from our website for use in it. The website Service and Shape Licence governs supplied shapes in SimpleDiagrams Cloud and uses the same artwork terms. The terms identified and agreed when you obtained a copy govern that copy; a later website or application update does not by itself replace those terms.

If you obtained SimpleDiagrams from the Mac App Store, your agreement for the application is Apple’s Standard Licensed Application End User License Agreement, and you may not have agreed to this Shape License separately. The permissions in this Shape License still apply to you, and its restrictions describe the limits of what we permit. Its warranty exclusions and liability limit apply to you only to the extent that you agree to them separately, for example when you create a SimpleDiagrams website account or download a library, or to the extent Apple’s agreement or the law gives them effect. Nothing in this Shape License reduces your rights under Apple’s agreement or under the law.

This Shape License grants additional permission to use and distribute Covered Shapes in finished output. It does not reduce rights granted by the applicable application license or any third-party license. If a term of this Shape License cannot operate consistently with the applicable application license, that application license controls for use of the application, and this Shape License applies only to the Covered Shapes to the fullest consistent extent.
